What Information does Level Up Collect?
Personal Information We Collect
Level Up will only collect Personal Information that you voluntarily provide to us or our service providers. If you register to create an account, the Personal Information we may collect includes, among other things, your name, mailing address, e-mail address, telephone number, birthday and your interest in specific types of products and/or services. If you are joining the Services as a teacher, we may also request that you voluntarily provide us with additional information about you to verify your background or credentials. You may also voluntarily provide Personal Information when you contact us with a question or feedback, interact with our social media page or participate in a survey.
Participating in Courses
You may also choose to post or upload additional information, such as videos, your teacher bio, photos or other content, including coursework or live stream Zoom calls (“Creator Content”) to publicly or semi-publicly available portions of the Services, such as your course room. Creator Content you post on the Services to promote or advertise a course will be available to other users of the Services and may be retrievable by third party search engines. Creator Content you post in a course will be available to students of the course. Third parties may also be able to download or share your publicly available Creator Content to social media sites such as Facebook, Pinterest, Twitter, Google+ as well as via email. We recommend that you guard your privacy and anonymity and not upload any Creator Content that you are not comfortable being available to the general public. Any third party with access to your information via the Services will be permitted to use the information in the same manner as if you submitted the information directly to that third party. Publicly posting any information on the Website is entirely voluntary on your part and we recommend you carefully consider the information you choose to make publicly available.
If you’re using Level Up’s Native Payment Gateways, you’ll need to link your payment account to our Platform to receive payouts. By linking your account, Level Up will receive certain payment-related information about you, including your payment card type and last four digits, postal code, country of origin, payment expiration date, and any email address associated with the payment type. Further, we will collect certain personal information for tax purposes. This tax information may include your full name, address, and registration number.
Like most website operators, Level Up collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request when visitors use the Services. Level Up’s purpose in collecting non-personally identifying information is to better understand how Level Up’s visitors use the Services. From time to time, Level Up may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its Services. Level Up also collects potentially personally-identifying information like Internet Protocol (IP) addresses and may collect statistics about the behavior of visitors to the Services. For instance, Level UP may monitor the Services to help identify spam. We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). We may receive and process information about your approximate location from your IP address and other information about you. Level Up does not ask for or track any precise location-based information.
In addition to log data, we may also collect information about the device you’re using to access the Services, including the type of device, the operating system, device settings, device identifiers and crash data. Whether we collect some or all of this information often depends on what type of device you’re using and its settings. To learn more about the information your device makes available to us, please review the policies of your device manufacturer or software provider.
We do not collect personal information automatically, but we may tie this information to personal information about you that we collect from other sources or you provide to us.
In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this type of information in order to increase the Services’ functionality. These third party service providers have their own privacy policies addressing how they use such information.
How We Use Your Information
Our primary purpose for using your personal information is to provide you with a smooth, efficient, and customized experience, for customer support, advertising and marketing communications, research and service development, and to keep our Platform and users safe and secure. Accordingly, your information may be used for the following purposes: (i) to provide and improve our services, features and content; (ii) to administer your use of our services and accounts; (iii) to enable users to enjoy and easily navigate the Services; (iv) to better understand your needs and interests; (v) to fulfill requests or to respond to questions or comments you may make; (vi) to personalize your experience; (vii) to provide you with announcements, notifications and advertisements related to your interests and use of the Services and other communications such as electronic newsletters, promotional e-mails or similar messaging; (viii) to provide service announcements; (ix) to protect against users seeking to hack into the Services; (x) to assess the level of general interest in the Services and (xi) for any other purpose with your consent.
With Whom Do We Share Your Information?
Level Up only shares your personal information with third parties under the circumstances described below. We do not sell or otherwise disclose personal information we collect about you for monetary or other valuable consideration.
When you participate in a Level Up course or other Creator Content, Level Up will share certain personal information about you (“Student Data”) with the Creator to allow the Creator to provide you with their services. The personal information that we share with Creators is limited to the following:
Enrollment in a course;
Your name and email address;
Amount paid for course;
Content you upload to the course or the Teacher;
Messages you send to the Teacher;
During your participation in a Level Up course, you may voluntarily share other content, including without limitation, your image and any comments you make during a Zoom call and any assignments, questions comments or or other work you communicate with your teacher or the entire course. Please avoid sharing personal information with a teacher or other students during a course and only share information you are comfortable disclosing.
Other Ways We May Share your Personal Information
We may disclose non-personally identifiable aggregated information about our users without restriction.
Other than to its employees, contractors and affiliated organizations or as described above, we disclose personally-identifying only when required to do so by law, or when we believe in good faith that disclosure is reasonably necessary to protect the property or rights of Level Up, third parties or the public at large. If you send us a request (for example via chat, a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users.
In addition, in some cases we may choose to buy or sell assets. In these types of transactions, user information is typically one of the business assets that is transferred. Moreover, if Level Up or substantially all of its assets were acquired, or in the unlikely event that Level Up goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Level Up may continue to use your personal and non-personal information only as set forth in this policy. Otherwise, we will not rent or sell potentially personally-identifying and personally-identifying information to anyone.
We may also disclose your personally-identifying information if you expressly consent to the disclosure.
Links to Third-Party Websites
We have no control over, and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.
Level Up uses a range of physical, technical, and administrative security measures to protect your personal information. For example, only authorized employees are permitted to access personal information, and they may do so only for permitted business functions. In addition, we use encryption in the transmission of financial information between your system and ours, and we use firewalls to help prevent unauthorized persons from gaining access to your personal information. However, no method of data transmission or storage system is absolutely secure, and we cannot guarantee that your personal information will not be accessed, disclosed, altered, or destroyed in the event of a breach of any of our security measures.
Where we have given you (or where you have chosen) a password to access certain parts of our Platform, you are responsible for protecting this password and keeping it confidential. As the safety and security of your information also depends on the precautions you take, we ask you not to share your password with anyone. If you believe your password or the security of your account has been compromised, you should change your password immediately and contact [email protected] with any concerns.
We save personal information we collect for as long as it is necessary for the purposes for which the personal information is collected and processed. Generally, we will keep your personal information until your account is deleted, or as needed to provide you with our services. We will also retain certain personal information to comply with our legal obligations or for our legitimate business purposes.
Your Rights and Responsibilities
You are permitted, and hereby agree, to only provide personal information Level Up if such personal information is accurate, reliable, and relevant to our relationship and only to the extent such disclosure will not violate any applicable data protection law, statute, or regulation.
Level Up gives you choices with respect to our use of your personal information. These choices include accessing, updating, or deleting your personal information, as well as choosing what communications you would like to receive from us. Depending on your location, you may have additional rights related to your personal information (see the Jurisdiction Specific Provisions section below for more information about location-specific privacy rights).
You can also choose not to provide us with certain personal information, but that may result in you being unable to use certain features of our Platform because that information may be required for you to register for an account, purchase Level Up Services, enroll in Creator Content, participate in our promotional offerings, get customer support, or engage in other activities on our Platform.
Accessing, Updating, and Deleting Your Personal Information
You can access and update certain personal information about you by visiting your Account Settings.
You can also submit a data privacy request to receive a copy of personal information that we hold about you, free of charge.
If you believe that any personal information we are holding about you is incorrect or incomplete, we will work with you to make corrections deemed necessary. Note that we may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
If you’d like Level Up to delete your account or delete personal information it holds about you, you can submit a deletion request. Note that when we delete your account, personal information that you have shared with others (for example, through comments or an intake form) may still be visible. Level Up will also retain certain personal information about you where reasonably necessary to comply with our legal obligations or for our legitimate business purposes.
Data Privacy Requests and Verification
You can request to access, update, or delete your personal information by emailing us at [email protected] from the email address associated with your account.
If you would like to make a request under the privacy laws of your jurisdiction, please let us know where you reside and which rights you’d like to exercise. For more information about exercising your jurisdiction-specific privacy rights, please see section ‘Jurisdiction Specific Provisions’ below.
To protect your privacy, we need to verify your identity before we process your data privacy request. As part of this process, we will need to receive the request from you via the email address associated with your account. Depending on the nature of the request, we may also need to obtain additional information necessary for us to verify your identity.
You may designate an authorized agent to make a data privacy request on your behalf. To do so, we will need to receive written permission by you or a valid power of attorney, and we may also verify the validity of the request directly with you.
Controlling Promotional Communications
You can opt out of receiving some or all of our promotional communications through the unsubscribe link in the email or by emailing info@Levelupwithus.com.
If you opt out of promotional communications, we may still send you transactional communications, such as service announcements, administrative and legal notices, and information about your account, without offering you the opportunity to opt out of these communications. If you no longer wish to use our Platform or receive any communications from us (except for those that are legally required), please contact [email protected]us.com to have us delete your account.
Please note that opting out of promotional email communications only affects future communications from us. If we have already provided your information to a third party (such as a credit card processing partner) before you changed your preferences or updated your information, you may have to change your preferences directly with that third party.
Controlling Cookies and Similar Technologies
Do Not Track Signals
Your browser may give you the option to send a “Do Not Track” instruction to websites you visit. However, since there is no accepted standard for how a website should respond to this instruction, we do not currently recognize or respond to these signals.
Jurisdiction Specific Provisions
Users in the European Economic Area, UK, and Switzerland
Under the General Data Protection Regulation (GDPR) and other applicable laws, users in the European Economic Area (“EEA”), UK, and Switzerland have the right, under certain conditions, to request access to, rectification of, or erasure of their personal information; request restriction of processing; object to processing; withdraw consent from processing; and the right to data portability.
If you are in the EEA, UK and Switzerland and would like to exercise these rights, please email us at [email protected] pursuant to the ‘Data Privacy Requests and Verification’ section above. Please include the phrase “GDPR request” in the subject line and provide us with your mailing address and state of residence.
Level Up only collects and processes and transfers personal information about you where it has lawful bases for doing so. The specific legal basis applied to the processing will depend on the context in which the personal information is being processed, including the service used and the type of personal information involved.
Level Up uses the following legal bases for processing:
For legitimate interests. We will process your personal information for our legitimate interests or those of others (as long as the processing is not outweighed by your data protection interests). This includes but is not limited to, preventing fraud and other abuse, ensuring the security of our Platform, protecting our legal rights and interests, conducting market research and product development, and for marketing purposes.
To comply with legal obligations. We will process your personal information to comply with all applicable laws, regulations, court orders, and government and law enforcement agencies’ requests.
Consent. We will process your personal information when you have given us consent to do so, such as when you consent to receive certain communications from us.

If you believe that we have not adequately addressed your concerns or wish to report an alleged infringement of applicable data privacy laws, you may file a complaint with your local supervisory authority.
Users in California
California Civil Code Section § 1798.83 permits users of the Sites that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Pursuant to the California Consumer Privacy Act of 2018, as amended (“CCPA”), California residents may have certain data privacy rights, such as the right to be notified about what personal information categories are collected about you, and our intended use and purpose for collecting your personal information. You have the right to request access to your personal information and, to the extent feasible, request that it be transmitted in certain forms and formats. You may have the right to request that we (and any applicable service provider) delete your personal information. You have the right not to be subject to discrimination for asserting your rights under the CCPA. If you make, or an authorized agent on your behalf makes, any request related to your personal information, Level Up will ascertain your identity to the degree of certainty required under the CCPA before addressing your request. Level Up may require you to match at least three pieces of personal information we have previously collected from you before granting you access or otherwise responding to your request.
Nevada Privacy Disclaimer
Pursuant to Nevada law, a Nevada “consumer” (as the term is defined therein), may, at any time, submit a verified request through a designated request address to an “operator” directing the operator not to make any sale of his or her personal information that the operator has collected or will collect about the consumer. For clarity purposes, Level Up does not sell or exchange your personal information for monetary consideration to a third party for the third party to license or sell the information to additional persons or parties.
